ORLANDO, Fla. — A body found over the weekend in a wooded area has been identified as missing woman Miya Marcano.

The chief medical examiner for Orange and Osceola counties announced the positive identification Tuesday. The medical examiner said the exact cause and manner of death will be deferred to the Orange County Sheriff's Office, since the case is still under investigation.

Marcano had been found near the Tymber Skan on the Lake condominiums Saturday. 

The 19-year-old Valencia College student had been missing since Friday, Sept. 24 from the Arden Villas apartments near UCF, where she worked. 

The attorney for the family says he was surprised to hear that the case was still under investigation because he thought that the Sheriff John Mina had said the case was closed.

Attorney Daryl Washington says there is more information into Marcano's, but it was information that the sheriff's office needed to release.

Washington also said that funeral arrangement information will be released in the next few days. 

Investigators believe a person of interest, Armando Caballero, is connected with Marcano's death. The 27-year-old worked in the same complex as a maintenance worker, and is believed to have made unwanted advances toward Marcano. Investigators say he used a master key to go into Marcano's apartment on Sept. 24.

Caballero was found dead a few days later at his apartment in Seminole County. Investigators believe he committed suicide.

Washington said the family is still looking at possible litigation against Arden Villas, because he says that couldn't possibly have done a thorough enough background check into Caballero when he was hired, despite the Arden Villas management's statement to the contrary. He says people have come forward and said that Caballero had been found in other apartments without permission before.

"We know that there's a statement conducted by the arden villas that they conducted an extensive background check," Washington said. "Well if they conducted an extensive background check, it definitely was not extensive enough. It was not the type of background check that should be conducted when you are giving someone access, free access, to somebody's apartment."

Washington also said the family has not heard from Arden Villas management, even to offer condolences, however he did talk to an attorney for the complex before the news conference Tuesday, just to make introductions.

Meanwhile, residents are still calling on Arden Villas to make changes to safety protocols. A protest is being held outside the complex gates on Wednesday evening. The complex has said it is making some changes, but Washington said it was not enough. 

"If it's something that they're doing right now, why weren't they doing it before?" Washington said. "There's just so many major questions that we want to ask. Why did that person have free access to miya's apartment and everyone else's apartment? It makes no sense at all."
