A Deltona man is behind bars after investigators said he shot his brother Sunday during an argument over their mother.

Investigators say Joel Almonte, 21, and Gilbert Rivera, 28, had been arguing throughout the day about Almonte's lack of respect for their mother. At some point, Almonte told Rivera that if he didn't leave him alone, he would shoot him.

Detectives say Rivera then got his brother's rifle and handed it to him while in the garage, daring Almonte to shoot him. Almonte took the rifle and backed Rivera into a corner, then fired twice at close range, hitting Rivera in the arm and leg, detectives say.

Tilar Harris, 21, was also in the garage at the time, and detectives said he was apparently injured by a ricocheting bullet.

Deputies arrived at the house in the 800 block of Vicksburg Street shortly before 4 p.m., and Almonte was taken into custody a few minutes later without further incident.

Both Rivera and Harris were taken to local hospitals to receive treatment for their injuries.

Almonte is facing charges of attempted murder and attempted felony murder. He was taken to the Volusia County Branch Jail in Daytona Beach, where he is being held without bond.
