The man whom Orlando police say caused a disturbance outside the Vixen Bar and forced officers to open fire, killing a woman with a stray bullet, was released from the hospital Wednesday and taken straight to the Orange County Jail.

Kody Roach has been charged with second-degree murder for the death of the bystander, 22-year-old Maria Godinez.

Roach, 23, had been recovering in the hospital since August from gunshot wounds received during the officer-involved shooting on Aug. 19. Orlando police officers fired nine shots after they said they thought Roach was reaching for a gun.

Roach is scheduled to appear before a judge Thursday morning on his charges, which also include attempted armed burglary and armed trespassing. Those charges stem from accusations that Roach was waving around a gun inside the bar and tried to forcefully re-enter after being thrown out earlier.
