The Kissimmee Planned Parenthood clinic can once again perform abortions and diagnostic procedures after an appeals court lifted an injunction Wednesday.

Planned Parenthood was barred in July from performing not only abortions, but ultrasounds and mammograms. A judge ruled in favor of the medical plaza's tenants, who said the property's covenant prohibited those procedures without permission.

The appeals court wrote in its decision the lower court erred because the plaintiffs never filed its suit against diagnostic imaging services. The court ruled Planned Parenthood's surgical work did fall in line with the property's rules, and the lower court was wrong to say that Planned Parenthood was not a physician's practice simply because it was a charity.

The clinic near Osceola Regional Medical Center is Planned Parenthood's third in Central Florida. It opened to protests in May.

Jenna Tosh, Planned Parenthood CEO, issued this statement:

"We are pleased that the appeals court recognized that the injunction was wrongly entered. Since opening our doors to the community in July, our Kissimmee Health Center has provided care to over 600 women and men. We look forward to continuing to serve our patients in Osceola County and providing a wide range of essential reproductive health care services."
