COCOA, Fla. — A Cocoa police officer accused of opening fire in 2018 on a man who called 911 has been cleared by the Florida Department of Law Enforcement.

FDLE agents determined Officer Xzevies Baez lawfully used force against 54-year-old Keith Seal, who Baez shot after was he allegedly feared for his life.

On December 11, 2018, police responded to an early morning call from Seal, who said he was concerned about a loved one.

When Baez responded to the Cocoa home on Forrest Avenue, he told investigators that he shot Seal because an “aggressive act” was made toward him.

"(There was) some sort of aggressive act toward the officer and made him feel in fear, and what occurred from there occurred," Cocoa Police Chief Mike Cantaloupe said in December.

Authorities say Seal was not armed at the time of the shooting. The injuries he sustained were not life-threatening.

FDLE says no further actions will be taken.
