Cocoa Beach police say they were forced to use deadly force on a man they believed was a “violent, imminent threat."

Fifty-nine-year-old Tim Berger was shot and killed in his Cocoa Beach home by two police officers.

The incident happened Friday night at the Royal Colonial Condos on 2001 S. Banana River Boulevard.

Berger’s wife called 911, who told dispatchers that Berger was intoxicated, suicidal and had shot a firearm inside their home.

When police arrived to Berger’s home, they attempted to make contact with Berger but were immediately met with an imminent threat, according to a news release.

Authorities say responding officers James Scheiner and Taylor Payne both shot their firearms at Berger. He died on-scene.

The officers were uninjured. Brevard County Sheriff’s Office and the Florida Department of Law Enforcement were contacted to handle the investigation.

Both officers were placed on paid administrative leave as standard protocol, police say.
