Everett Glenn Miller, the man accused of killing two Kissimmee police officers last month, is competent to stand trial, and the state will seek the death penalty.

Judge Greg Tynan made the ruling about his competency Friday afternoon during a hearing at the Osceola County Courthouse.

The judge had ordered a mental health evaluation for Miller, who friends and family said suffered issues stemming from his time in the Marines.

He is a 21-year Marine veteran.

A doctor said Miller had no delusions or was suicidal, and seemed fully oriented by time and place. The judge said Miller understood the charges against him and the penalties possible. 

Miller is charged in the shooting deaths of Officer Matthew Baxter and Sgt. Sam Howard last month.

Baxter’s wife, Sadia, sat in court wiping away tears — she originally had planned to make a statement, according to a coworker at the Florida Department of Law Enforcement.

“It was very emotional for Sadia Baxter and her family today," the FDLE's Angela Starke said. "It was her first time seeing Mr. Miller since the death of her husband, and she said she wished she could've said something to you today, but she can't. It was just too raw,” Starke said.

Miller waived his arraignment, entering a not guilty plea. The state on Friday said it intends to seek the death penalty.

"She wants the community to know that she senses their prayers and is asking that they continue to pray for her and her girls, who are without their father," Starke said of Sadia Baxter.​

A pretrial hearing is set for Dec. 12, with the trial set for Jan. 8.
