A 22-year-old man is accused of sexually battering a woman during a party in July at the Alpha Tau Omega fraternity house on the University of Central Florida's main campus, according to a police report.

Alexander Emilio Garces, of Merritt Island, faces charges of sexual battery on a person over 18 years old and false imprisonment.

A second person is also being investigated in connection with the incident, police said.

"There is an active warrant for a second arrest, but the suspect does not live locally," said Courtney Gilmartin, with the UCF Police Department. 

According to a police report, Garces allegedly raped the victim during the early morning hours July 22 at the fraternity house during a "New Years in July Party."

When Garces was contacted by the UCF Police Department, he invoked his right to remain silent and to consult with an attorney, according to a heavily redacted arrest affidavit.

Garces was arrested at about 6 p.m. Aug. 7 at the fraternity house. He was granted a $15,150 bond Tuesday but remained at the Orange County Jail as of noon Wednesday with a bond pending status.

The Alpha Tau Omega fraternity released the following statement Tuesday via email:

"Officials with the Alpha Tau Omega Fraternity learned of the police investigation on Saturday, and the chapter immediately suspended the man. ATO is conducting an internal investigation and will assist local authorities and university officials as requested. The alleged assault reportedly occurred during a July 22 party at the chapter house. The part was approved by UCF and held in accordance to strict university guidelines."
