  • Robert Mosher, 71, charged in the incident

Volusia County deputies responded at about 1:22 a.m. to the incident along Alice Drive.

Robert Mosher, 71, told deputies he was asleep in bed when he heard someone kicking and pounding on his front door. He told deputies he grabbed a 9mm handgun and went to check on the noise.

He then said he saw a shadow through the front window and accidentally fired a shot through the window. He told deputies he opened the door, saw a female running down the driveway while yelling and then fired another round toward her as she ran away, according to a news release.

The victim, a 38-year-old woman, wasn't shot, but she was hurt by flying glass. She told deputies she went to Mosher's front door to confront him about a dog that was loose on her family's property and had attacked her.

After the shot was fired, the victim initially thought she was hit by a shot from a shotgun, but she discovered the cuts on her arm and abdomen were from the flying pieces of glass. She declined medical treatment, deputies said.

Mosher was charged with aggravated battery with a deadly weapon in the incident. He was transported to the Volusia County Branch Jail, where he was released later Thursday after posting $20,000 bond.
