Graphic images of the 2009 crime scene where Bob Ward shot his wife were shown during a hearing Thursday to determine whether the former Isleworth millionaire can be released on bond while awaiting a new trial.

Ward is asking to be released into the care of his daughter, Mallory, who lives in the Atlanta area, on a $100,000 bond while awaiting a new trial.

His daughters and attorneys argue that with Ward's conviction recently overturned, he should be released.

"I've lost so much time with him already. I want to spend as much time as possible with him," said Sara Ward, who lives in San Diego.

Mallory Ward said she would do whatever it takes to help her father to be released and prove his innocence.

The state, however, argued that Ward is guilty and dangerous. The state's lawyers recapped Ward's 2011 trial, showing graphic images of Diane Ward the night she was shot and killed. They said Diane was shot from 18 inches away, making it impossible for a 5-foot, 7-inch woman to shoot herself.

“He had to have been the person who shot her,” state attorneys said.

In 2009, Ward called 911 claiming he accidentally shot his wife, Diane, in the face at the couple's Isleworth Country Club home. In it, he tells the dispatcher that he shot his wife but that there was a struggle, and it was an accident.

Ward was convicted and sentenced to 30 years in prison in 2011 for the fatal shooting. The conviction was overturned in 2016, because a judge said Ward's previous attorney erred by not objecting to certain evidence.

For now, Ward will remain jailed. The Orange County judge decided to wait on making a final call but said she's inclined to keep Ward in jail through his September trial, because his family doesn't live in this state any more.

The judge said she will take time to review what was discussed during the hearing, as well as Ward's finances, before making a decision on a bond amount.
