A man shot by Volusia County deputies after a carjacking spree remained in the hospital Wednesday morning.

Volusia County Sheriff's deputies said they were forced to shoot 28-year-old Justin A. Kaegael of Paisley as many as four times in the neck Tuesday night.

According to investigators, a fight between Kaegael and his boyfriend at the Discount Market in DeLand led him to stealing his boyfriend's car and dragging him.

Sheriff's Office investigators said Kaegael crashed that car, then a good Samaritan came into the picture.

“The owner of a red Saturn pulls up as a good Samaritan, to give help, (then) the bad guy jumps into his car and takes off,” Sheriff Mike Chitwood said Tuesday night.

Driving down Interstate 4, deputies decided not to pursue the man but to follow him with a helicopter and then use stop sticks. The stop sticks worked, and the driver got off an exit toward Highway 92.

Chitwood said the man then carjacked another victim, who was driving a silver truck on Belleview Avenue. Two deputies arrived at that scene.

Chitwood said that's when he started to drive toward deputies, who opened fire.

“From looking at the body camera video, if he doesn’t put the vehicle in drive and try to come out of there at them, he doesn’t get shot,” Chitwood said.

Two deputies — later identified as David Teske, 33, and Bryan Luoma, 48 — fired their weapons and struck the man four times.

The Florida Department of Law Enforcement is investigating the deputy-involved shooting, and the deputies are on paid administrative leave, per standard procedure in shootings.

Kaegael is charged with two counts of carjacking and one count each of kidnapping and grand theft of a motor vehicle. Additional charges are pending.
