Luis Toledo’s attorneys are using brain scans to try to prove he does not deserve a death sentence.

"Those black spots (on the PET scan) ... are areas of the brain which are typically abnormal," Dr. Joseph Wu, a psychiatrist testifying on behalf of the defense, testified Thursday.

Jurors found Toledo guilty of killing his wife and stepchildren last week. Toledo was in court for his sentencing. He faces a minimum of life in prison but could get the death penalty.

For hours, psychologists for the defense testified about Toledo's mental health history, seizures and what they say is an abnormal brain.

His defense says that may be the reason why he killed his Yessenia Suarez after he found out she was having an affair and also killed her children in October 2013.

On Thursday, the state argued the killings warrant the death penalty and said through their own psychiatrist's testimony that there isn't concrete proof Toledo's brain is abnormal.

"He wasn't presenting the symptoms of someone with a psychological disorder," Dr. Robert William Meadows, a forensic psychologist for the state, testified Thursday. "In my opinion... he isn't suffering a psychological disorder."

As jurors processed all this information, Toledo processed a warning from Judge Raul Zambrano.

In court Thursday, Toledo was warned to stop using hand signals to communicate to someone.

"There were a certain number of hand gestures you made that were picked up by some of the cameras," Zambrano said to Toledo. "No. 1, it was an unwelcomed distraction for this trial. No. 2, it's a security violation, so I'm going to warn you not to do that again," Zambrano said.

After the warning, Toledo kept his hands down.

Closing statements are expected Friday morning, and the jury will begin deliberations after that.
