A 71-year-old man has been arrested after deputies say he fired a weapon in the yard of his DeLand home on Sunday.

Deputies responded to Brevity Lane about 2 a.m. after receiving reports that Herbert Tipton was firing one of his weapons. His adult daughter told deputies he wouldn’t let her leave the house because he believed there were intruders trying to hurt them. He also told her he shot someone, deputies said.

Twenty minutes after deputies arrived at the scene, Tipton began firing shots inside the home.

A deputy who knows Tipton was able to convince him to let his daughter leave the house. Several minutes later, Tipton dropped his weapon and exited the home.

The incident was resolved peacefully, the Sheriff’s Office said. Tipton and his daughter were not injured.

Deputies later found several guns and ammunition in the home.

Tipton was arrested and charged with reckless discharge of a firearm, aggravated assault and false imprisonment.

According to deputies, Tipton armed himself with a rifle on Oct. 18 to defend himself against "an imagined threat" in his front yard.
