The trial against the man accused of murdering his wife and her two children began Wednesday with opening statements, with the prosecution saying that Luis Toledo snapped when he found out that his wife was having an affair.

Luis Toledo is accused of killing his wife Yessenia Suarez, and her two children Thalia and Michael Otto back in October of 2013. But their bodies have never been found.

On Wednesday, the state presented its case against Luis Toledo in their opening statements. The prosecutor says this all started when Suarez, unhappy in her marriage, had an affair with a co-worker.

That is when Toledo found out, tracked Suarez's moves, threatened divorce, but instead snapped, the prosecution stated.

The prosecution claim he killed Suarez in a rage, but killed her children to cover up the crime. And they say even without their bodies they have the evidence to prove he killed them.

"They will describe the bathroom as being wet...and one tiny bit of blood that will be his undoing," Assistant State Attorney Ryan Will said.

But the defense argued the state cannot even prove that a murder even happened just that Suarez and her two children are dead.

Furthermore, they say the evidence does not show Toledo had anything to do with their deaths.

“There is no direct evidence to show how the children died. There is no bloody crime scene. There is no witness,” Jeff Deen said.

Wednesday afternoon the first witnesses will testify in this case.
