A 47-year-old Orange City man is dead after deputies said he pointed a gun at law enforcement officers and they were forced to open fire.

  • Officers tried to talk to man, used nonlethal rounds, they said
  • Deputies say man pointed gun at officers
  • Man was identified as Westley Daum, 47

The Volusia County Sheriff's Office identified the man Tuesday afternoon as Westley Daum.

The incident unfolded at about 11:30 p.m. Monday in Orange City when Volusia deputies began getting calls from people that a man was parked in the middle of Volusia Avenue pointing a gun at passing motorists.

Orange City Police responded, along with Volusia deputies, but the man left the scene by the time they arrived.

Deputies spotted the man again a short time later in his truck several blocks away on Lantern Lane. They said the man took off and led deputies through residential neighborhoods. He meandered through several back roads before again returning to the 600 block of Lantern Lane.

That's when deputies said the man got out of his truck with a weapon in hand. He was surrounded by deputies and Orange City officers, and nearby homes were evacuated.

When talking to the man did not work, officers tried to shoot him with nonlethal bean-bag rounds, which were not successful, deputies said.

Just before 12:30 a.m. Tuesday, the man pointed his gun at officers and several deputies and one Orange City officer opened fire, officials said.

The five deputies who utilized deadly force in the shooting are as follows: Sgt. Kyle Brainbridge, Sgt. Joel Hernandez, Sgt. Justin Stewart, Investigator Miguel Roman and Deputy Austin Weber.

All five have been temporarily placed on administrative leave with pay, which is standard procedure in deputy-involved shootings.

The Orange City Police Department officer who fired his weapon is Officer Stephen Nesbitt.

The Volusia County Sheriff's Office said this was the fourth deputy-involved shooting of 2016.

The Florida Department of Law Enforcement is investigating.
