The trial of Luis Toledo, the Volusia County man accused of killing his wife and her two children in 2013, has been pushed back until after the New Year.

A judge Monday rescheduled Toledo's murder trial date to Jan. 4, 2016. It was initially set to begin in September of this year.

Monday was the second time Toledo has been in court in the last month. In early June, Judge Luis Zambrano granted Toledo's lawyers and prosecutors access to the home of Toledo's wife, Yessenia Suarez, adding neither side cannot retrieve any evidence or conduct any destructive testing.

Suarez and her children, 9-year-old Thalia and 8-year-old Michael Otto, disappeared in October 2013. Their bodies were never found, and detectives have presumed all three dead.

Another hearing in the case has been scheduled for September.
