The judge in the case of a Deltona man charged with murdering his wife and her two children has ordered the state to tell his lawyers how the victims died.

Luis Toledo is charged with second-degree murder in the death of his wife, Yessenia Suarez, and two counts of first-degree murder in the deaths of her children, 8-year-old Michael Otto and 9-year-old Thalia Otto.

The three victims have been missing since 2013. Their bodies were never found.     

Judge Margaret Hudson asked prosecutors to provide how the three victims were killed.

"It's no secret," State Attorney Ed Davis said to the judge Thursday. "We have it in the report. The discovery, the manner of death is homicide and the cause of death is unknown."

Toledo's lawyer, Jeff Deen, said: "If they're saying there's no cause of death, then what is actually charged becomes more in focus. When we don't ask for anything, they can prove everything."

Toledo allegedly confessed to killing Yessenia but claimed he did not kill the children.

The State Attorney's Office, as well as sources with Toledo's defense team, said they are aware of claims that members of the Latin Kings killed the children.

Felicia Perez, Suarez's mother, said this is the first time she's hearing about the Latin Kings connection.

"It does surprise me," she said.

A former state prosecutor said Toledo was a former high-ranking member of the Latin Kings, but Suarez's family believed he gave up gang membership to get married.

"I thought he was out of this," Perez said.

Detectives said Toledo has not revealed any information on the whereabouts of the three victims.

Hudson also pushed back the trial from June to Sept. 8. Toledo remains at the Volusia County Branch Jail without bond.
