As the legislative session gets underway in Tallahassee, a Brevard County lawmaker is looking to put some bite into the state's 'texting while driving ban'. 

Right now, if law enforcement saw someone texting while driving, they couldn’t pull that person over.

Drivers can only be charged with texting while driving if they are pulled over for another reason.

The law has only been in place since October 2013, and it has resulted in very few citations so far.

Here in Central Florida, we still see that the ban hasn’t dissuaded drivers from the dangerous habit.

That’s why State Senator Thad Altman of Viera, along with other lawmakers are proposing making texting while driving a primary offense, instead of a secondary offense.

Opponents say instead of a new law, a better awareness campaign is needed to stop distractive driving.

It’s going to be an uphill battle.

It took several years for state lawmakers to pass the original texting while driving ban.
