The man blamed for the police shooting that killed a bystander inside an Orlando night club will stay in jail.

Friday a judge denied bond for Kody Roach after his attorneys argued he is not getting proper medical care in jail.

Roach testified during Friday's hearing. He claimed he is not getting the physical therapy in jail that he needs.

Roach said he still has two bullets in him that need to be removed. He said he is supposed to go to physical therapy three times a week but at times has only gone once a month.

The judge did not find enough evidence of physical harm to issue a bond. Roach will remain in jail until his trial.

"The family's concern and our concern is that he is not getting the proper treatment at the Orange County jail," said Roach's attorney, Harvey Cohen. "He's supposed to be going two to three times a week. As testimony came out today sometimes he's going once a month, so that was our main concern."

Roach is accused of second-degree murder and several other felony charges for the shooting which happened in August of 2014.

Roach was shot several times after police tried to stop him with a stun gun outside of the Vixen night club.

Police were called to the club because he had a gun and was allegedly making threats.

One of the shots fired by police hit and killed Maria Castillo, a bystander in the incident.

A trial date for Roach has not been set.
