It's back to court for a Brevard County man who has been charged with murder in the 2012 shooting death of a Jacksonville teenager.

In February, Michael Dunn was convicted of three counts of attempted first-degree murder for shooting into a fleeing SUV at a Jacksonville convenience store.

A Duval County jury, however, remained deadlocked on a first-degree murder charge.

Dunn, a Brevard County resident, testified that he thought he saw 17-year-old Jordan Davis point a shotgun at him as they argued over the loud music coming from the vehicle in which Davis was a passenger.

Dunn, 47, who is a software developer, said he feared for his life as he reached for his own pistol, firing nearly a dozen rounds into the SUV as it sped off that November 2012 night.

Davis was the only one in the SUV who was struck by a bullet.

Investigators never found the weapon Dunn said he saw.

A new pool of potential jurors will report Monday to the Duval County Courthouse, which is located in downtown Jacksonville.

Dunn's new attorney has asked for a change of venue, arguing the previous media coverage makes it impossible for her client to get a fair trial in Jacksonville.

The judge in the case said he will make a decision on the motion during jury selection.

If finding a jury in Duval County proves impossible, that will delay the trial for months.

Dunn has yet to be sentenced for the February convictions.

Circuit Judge Russell Healey ruled he'd do that following this re-trial.

No matter the outcome of this retrial, it is doubtful Dunn will ever get out of prison. He faces at least 60 years on the attempted murder convictions.
