Picture this: It's late at night, you are driving alone, and you slow to a stop at a red light. You immediately see somebody rushing straight for your car and you feel you are in danger.

Can you go through the intersection without getting a ticket?

We turned to Florida Highway Patrol Sgt. Kim Montes for a legal answer. Here's what she told us:

Law enforcement can't condone breaking the law to avoid a situation. However, drivers should safely do whatever they need to do to get out of a dangerous situation.

If someone were to receive a ticket for breaking the law from trying to get away from a dangerous situation, they would always have an opportunity to go before a judge and explain the situation as to why they broke the law.

Keep in mind, Montes says they do get a lot of excuses, so if an officer witnessed something going down and somebody running a red light, they would have to verify their story that they were in fear.

Montes said it's the FHP's job to make sure people know they are being safe. Even when a potentially dangerous situation occurs, they have to respond in a safe way.
