A 25-year-old man is accused of looting a restaurant after curfew in Polk County on Tuesday.

Mark Elortegui of Lakeland was arrested on charges of burglary during a state of emergency, grand theft, VOP, and violation of curfew on Wednesday, Sept. 13. 

Deputies said Elortegui stole $300 worth of alcohol from Dona Julia's Mexican Restuarant on Sept. 12 during the state of emergency, and after the midnight to 5 a.m. countywide curfew. 

Deputies orginally responded to the Wilmington Apartments just before midnight Tuesday after witnesses said they saw a suspect yelling and acting erratically in a breezeway at the apartment complex. 

Deputies determined that Elortegui matched the suspect seen in surveillance video from the Dona Julia's burglary. Elortegui admitted to burglarizing the restaurant, stealing food and alcohol. 

Deputies said Elortegui has a previous criminal history of possession of Xanax, trespassing, possession of marijuana, possession of drug paraphernalia, VOP, and DUI.

He was booked into the Polk County jail.
